TERMS AND CONDITIONS OF SERVICE FOR CLINICAL STUDY CENTERS

These Terms and Conditions of Service (these “Terms”) are applicable to Clinical Study Centers who have entered into a Clinical Study Agreement with Know Healthtech, Inc. and supplement the provisions of such Agreement. Please read these Terms carefully as they contain important information about your legal rights, remedies and obligations. By accessing or using the Sites (as hereinafter defined), you agree to comply with and be bound by these Terms.

By using or accessing the websites provided by Know Healthtech, Inc. (“Know Rare,” “we,” “us” or “our”), a subdomain of such website, any mobile application tablet and desktop applications for such website or any other website operated by us on which these Terms are posted via a link or otherwise (each referred to herein as a “Site” and collectively as “Sites”), you acknowledge and agree that these Terms govern your access to and use of the Sites.

1. Modifications

Know Rare reserves the right, at its sole discretion, to change, modify, add or remove any portion of these Terms, in whole or in part, at any time.  It is your responsibility to check periodically for any changes we make to these Terms.  Your continued use of the Sites after any changes to these Terms or other policies means you accept the changes.

2. prohibited activities; no reverse engineering, etc. 

You are granted a limited, revocable, non-exclusive license to access the Know Rare Sites solely for purposes relating to your Clinical Study Agreement with Know Rare. When accessing the Sites for the foregoing purposes, you must comply with these Terms. Any use of the Sites that is not for one of these purposes or otherwise in accordance with these Terms or as otherwise authorized by us in writing is expressly prohibited. Your license to use the Sites only extends to the uses expressly described herein.

No tiene derecho alguno a recopilar, agregar, copiar, extraer, duplicar, mostrar ni realizar ningún uso derivado de los Sitios, ni tampoco a utilizar técnicas de minería de datos, robots, arañas u otras herramientas similares de recopilación y extracción de datos sin nuestro permiso previo por escrito, salvo con el único fin de mostrar hipervínculos a los Sitios a través de motores de búsqueda en Internet, siempre que estos lo hagan desde una dirección IP estable o un rango de direcciones IP utilizando un agente fácilmente identificable.

No nos hacemos responsables si no dispone de un dispositivo compatible o si descarga una versión de la aplicación que no es la adecuada para su dispositivo.

By accessing the Sites, you further represent and warrant that:

  • You will not copy, distribute or reverse engineer the services provided through the Sites or the Site’s content;

  • You will ensure that no unauthorized person shall have access to your Know Rare passwords or accounts;

  • You will promptly notify us in the event your Know Rare passwords or accounts have been compromised;

  • You will not try to harm the Know Rare Services or impair the proper operation of the network in any way whatsoever; and

  • You will abide by all applicable laws, rules and regulations applicable for your use of the Sites, and any transaction that you enter into on the Sites, or in connection with your use of the Sites.

3. Content and right to use

You acknowledge that you are responsible for any material you submit on or via any Sites, including the legality, reliability, appropriateness, originality and copyright of any such material.  You may not upload to, distribute or otherwise publish through any Sites any content that (i) is confidential, proprietary, false, fraudulent, libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, infringing on intellectual property rights, abusive, illegal or otherwise objectionable, (ii) may constitute or encourage a criminal offense, violate the rights of any party or otherwise give rise to liability or violate any law, or (iii) may contain software viruses, political campaigning, chain letters, mass mailings or any form of “spam.”

The Sites may link to or promote other websites, products, and/or services from other companies, some of which are operated by Know Rare or its affiliates and others of which are operated by third-parties.  These links are provided as a convenience to you and as an additional avenue of access to the information contained therein.  We have not reviewed all the information on those other sites and are not responsible for the content of those or any other sites or any products or services that may be offered through those or any other sites.  Inclusion of links to other sites should not be viewed as an endorsement of the content of linked sites.  Different terms and conditions may apply to your use of any linked sites.
